The H-1B visa program offers a vital pathway for U.S. employers to hire foreign professionals in specialty occupations. With the Fiscal Year (FY) 2026 H-1B cap season approaching, understanding the process and adhering to critical deadlines is essential for a successful application.

Key Dates for FY 2026 H-1B Cap Season:

• Registration Period Opens: March 7, 2025, at 12:00 p.m. Eastern Time • Registration Period Closes: March 24, 2025, at 12:00 p.m. Eastern Time • Selection Notifications: Expected by March 31, 2025 • Earliest Petition Filing Date: April 1, 2025

During this period, prospective petitioners and their representatives must use a USCIS online account to register each beneficiary electronically and pay the associated $215 registration fee per beneficiary.

Understanding the H-1B Visa

The H-1B visa allows U.S. companies to employ foreign workers in positions requiring specialized knowledge and a bachelor’s degree or higher in specific fields such as IT, engineering, healthcare, finance, and law. Eligibility Criteria:

The Registration Process:

1. Create a USCIS Online Account: Employers must set up an account to submit registrations. 2. Submit Beneficiary Information: Provide required details for each prospective employee. 3. Pay Registration Fee: A non-refundable fee of $215 per beneficiary is required. 4. Await Lottery Selection: If registrations exceed the annual cap, USCIS will conduct a random selection process.

Post-Selection Steps:

Employers with selected beneficiaries will be notified by March 31, 2025, and can begin filing complete H-1B petitions starting April 1, 2025. It’s crucial to prepare all necessary documentation promptly to meet filing deadlines.
